Actually it started before that when Jimmy B screwed Jackson form the head coaching job and brought in DiAntoni. To which Jeanie gave Kobe that massive 2 year extension there by eating up all their cap space. If they would have not signed Kobe to his extension first and say resigned Pau and maybe another PG like Bledose/Lowery/Thomas, or a Forward like Haywood. Lets say they had the cash or a one MAX FA in Haywood, then Resign Pau with bird rights and then Kobe with bird rights. Yeah they would be way over the cap but the starting line up would have been W. Johnson/Bryant/Haywood/Pau/J. Hill. Not devastating but far more competitive than 21-61.
Its designed to let teams sign their own FA if they are over the cap. But they cant purposely go over the cap once the season is over and then sign their own FA. I think only in situations where the FA is restricted and there is an offer sheet can they wiggle it through. Even then I think they started using the cap hold thing to keep teams from doing that. I dont know the current rules all that well but the rules back then I know wont let you do what you want.
